中纪委日前公布了对江西省和云南省两名落马贪官的处理结果,但两人只被开除党籍和降职,并没有被移送司法。网民炮轰中共姑息官场〝通奸党〞,评论则表示,这并不是一个好的趋势,或许对贪官〝网开一面〞的做法,以后会成为惯例。
中纪委和中国 监察部联合网站 ,在7月16号公布对江西省委原常委、秘书长赵智勇,和云南省委原常委、昆明市委原书记张田欣的处理结果,说两人〝利用职务上的便利谋取私利〞,因此开除党籍,取消副省级待遇,同时收缴违纪所得。
赵智勇连降七级被降为科员,张田欣连降四级,被降为副处级非领导职务。两人都将在明年退休,降职虽然将影响他们的工资和其他待遇,但是,中纪委并没有宣布要将两人的犯罪问题 移送司法机关,公布处分时,也没有用〝违法〞的字眼。
中共以〝反腐〞的名义,号称在十八大后一共拉下了35名省部级高官,其中18人被开除党籍公职,另有多人被移送司法,只有赵智勇和张田欣被〝降职〞处理。
中国资深法学专家赵远明:〝习李政权一直强调对于贪腐是零容忍度,然后要采取壮士断腕这么一种精神,但是你现在像这样的话,是不是出现了一种转机,用这种方式给贪腐人员留一条后路,因为你降级的话,他依然是国家公务人员。〞
除了经济贪污,赵智勇张田欣在落马前,还被媒体曾盛传〝生活腐化〞,〝包二奶〞。特别是张田欣,曾被云南电视台员工实名举报 包养女主播,同时还和多名女性有不正关系,但之后举报者却被送入监牢,目前还在服刑。而赵智勇则被指控,与江西某县城的现任女县长搞婚外恋。
最近一个月,至少已经有9名官员的荒淫生活被曝光,网民批评中共已经沦为〝通奸党〞,并质问:为什么张、赵这样贪腐,荒淫证据确凿的官员,只是降级,却可以逃过法律制裁?
讽刺的是,这一引发民间不满的处理手法,在中共喉舌《人民网》发表的文章 中,却被称为是〝反腐科学 化〞、〝法制化〞的表现。
香港《苹果日报》说,中共玩的还是党大于法的那一套,当局越标榜对问题官员降级处理的法制化,越难以掩盖权斗的实质。
评论指出,中共官场以前有〝三忌〞,如今只有站错队这〝一忌〞了。只要跟对了上司,索贿受贿、包二奶、或嫖妓通奸都不算什么。而赵智勇被清洗,只因他曾是前江西省委书记苏荣的〝大管家〞,苏荣东窗事发后,赵被牵连。
美国中文 杂志《北京之春》主编胡平 指出,中共是制度性的腐败,如果动真格反腐,会把所有的官员都反进去,所以只是选择 性的,把站错队的贪官打下去。
美国中文杂志《北京之春》主编胡平:〝只要谁腐败就要反,那中共官场几乎全都是腐败的,那靠谁去反?依靠群众你还去打压,你就只有靠一批官员去整另外一批官员,既然所有人都是腐败的,你要让大家相信你只要腐败都要挨整,那你连整人的人都没有了。〞
赵远明分析,中共面对遍地贪官,对贪腐数额不是特别巨大的淫官,或许会网开一面,这次对张、赵两人的处理方式,以后可能会成为惯例。
赵远明:〝我觉得这个趋势不是太好,因为你这样的话,这个腐败份子又得以生存了,因为过去中共很多情况就是这样,犯了错或犯了罪,当时给他免下去,过半年一年的话又从别处官复原职了,这个情况是很普遍的。〞
近年来,许多落马官员悄然复出,甚至官级得到提升,如三鹿奶粉事件中,质检总局食品 生产监管司原副司长鲍俊凯,落马后复出,升任安徽省出入境检验检疫局局长。甕安事件中,被撤销党政职务的原县委书记王勤,在悄悄复出后调任黔南州财政局副局长……
早在2011年,中国人民大学〝反腐败与廉政政策研究中心〞主任毛昭晖就曾指出,被问责的官员几乎100%的复出。

Anti-Corruption Leniency: Demoted But Spared Charges
The Commission for Discipline Inspection reported
the punishment of two corrupt officials in Jiangxi and Yunnan.
They were both expelled from the Party and demoted,
but were not charged.
Netizens criticized this leniency as the Party
committing ‘adultery.’
Critics indicate that this leniency towards corrupt officials
could form a trend.
The official regime website announced the punishment
of Zhao Zhiyong (Jiangxi Province) and Zhang Tianxin
(Yunnan Province).
Both were Provincial Party Secretaries
charged with corruption.
Both were expelled from the Party, had benefits
from the province cancelled, and gains confiscated.
Zhao Zhiyong was demoted to a clerk, Zhang Tianxin
down to the deputy level in a non-leadership position.
Both will retire next year.
The demotion will affect their salaries and other benefits.
The Commission did not transfer them to the judicial system
and made no mention of the ‘illegal’ activity.
Since the 18th National Congress 35 provincial and ministerial
level officials were sacked in the anti-corruption campaign.
Among them, 18 have been expelled from the Party
and their posts.
Others were transferred to the judiciary, only Zhao Zhiyong
and Zhang Tianxin was ‘demoted.’
Chinese senior legal expert Zhao Yuanming: “The Xi and Li
regime have emphasized zero tolerance for corruption
and their iron determination.
But now this leniency is a turning point for corrupt officials.
Even with demotions, they remain governmental workers.”
It was also rumored that Zhao Zhiyong and Zhang Tianxin
both had mistresses.
In particular, Zhang Tianxin’s affair with a female anchor,
as well as sex scandals with a number of women was reported
by Yunnan Television.
But the whistleblower, who was sent to prison,
is still in prison.
Zhao Zhiyong was accused of an affair with the incumbent
female county governor of Jiangxi.
In less than a month, the dissolute lives
of at least nine officials have been exposed.
Netizens criticized the CCP as having become
“the adultery party.”
They asked: “Why, as corrupt as Zhang and Zhao are,
and with the conclusive evidence of their sex scandals,
could they avoid legal sanction and only recieve demotion?”
Ironically, the regime’s lenient anti-corruption approach
was described by mouthpiece People’s Daily
as ‘scientific’ and an ‘act of legalization.’
Hong Kong’s Apple Daily commented that the approach
continues the rule, i.e., the Party above the law.
The more the CCP claims demotion a process of legalization,
the more it reveals the substantial power struggle.
It is commented that the so-called three taboos in the CCP
officialdom are now down to only one.
That is the political stand.
With right boss, taking bribes, having mistresses,
committing adultery or prostitution, it will become nothing.
Zhao Zhiyong was attacked only because he was
the ‘housekeeper’ of former Jiangxi Provincial Party
Secretary Su Rong.
He was implicated because Su Rong was sacked.
Beijing Spring magazine Editor Hu Ping indicates
the corruption is institutional within the CCP.
Anti-corruption will implicate every official.
Therefore, only the corrupt officials in the wrong political
faction will be selectively crushed.
Hu Ping: “The entire CCP officialdom
is filled with corruption.
Who should conduct the anti-corruption?
Ordinary people will only be repressed.
Therefore, it is reliant on a group of officials to attack
another group of officials. No one is clean in the CCP.”
Zhao Yuanming analyzes that faced with corrupt officials
everywhere, corrupt officials not engaging in a huge amount
will probably get spared, such as what Zhang and Zhao have
experienced. But, this approach could become a norm.
Zhao Yuanming: “This trend is not good.
It allows the corrupt elements to survive.
It has happened before.
The officials were punished for misdeeds, but within a year,
will regain their ranks somewhere else.
It has been very common.”
In recent years, many sacked officials quietly came back,
and even promoted.
For instance, Bao Junkai, former deputy director of the food
safety department, was sacked over
the tainted Sanlu milk powder.
He later became the Director of Anhui Immigration
Inspection and Quarantine Bureau.
Wang Qin, for instance, had his Party Secretary position
at Weng’an revoked over the rape and murder incident.
But he later became the Deputy Secretary for Finance
Bureau of Qiannan.
Back in 2011, the Preventing and Curbing Corruption Center
Director of Renmin University of China, Mao Zhaohui,
pointed out that almost 100 percent of officials who were
held accountable would come back.
